When you reserve a charter or access our Service, you consent to adhere to these Terms. Should you object to any of the terms here, you are then not permitted to use the Service.

2. Service Overview

OpenIsleCommons offers upscale yacht renting services, which include, among others:

  • Yacht hires for day trips
  • Evening boat tours
  • Company getaways
  • Exclusive gatherings
  • Yacht leases spanning multiple days

Service offerings depend on availability and the conditions of the weather. We retain the privilege to either amend or cease services as we see fit.

3. Booking and Reservations

3.1 Booking Process

To arrange a charter, you must:

  • Have reached the age of 18 and over
  • Ensure provided details are truthful and comprehensive
  • Make the necessary initial payment as denoted in the booking confirmation
  • Accept the Terms & Conditions outlined here

3.2 Confirmation

You will receive booking confirmation only after we acknowledge receipt of your payment and provide written validation. We have the authority to decline service to anyone based on our judgement.

3.3 Availability

Charter reservations are contingent on both the availability of a vessel and favorable meteorological conditions. We shall strive to oblige your requested dates and timings.

4. Payment Terms

4.1 Pricing

All fees are presented in € and incorporate all relevant taxes, unless stated differently. Prices can be adjusted without prior announcement.

4.2 Payment Schedule

  • Deposit: 50% of the full cost for the charter, due at the time of reservation
  • Remaining payment: Due 48 hours ahead of the scheduled departure of the charter
  • Any extra costs (if applicable): Due upon the charter's conclusion

4.3 Payment Methods

Accepted payment methods include major credit cards, wire transfers, and authenticated cheques. Payments are processed through secure, encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full repayment less processing fees
  • Between 24 to 72 hours prior to departure: 50% returned
  • Less than 24 hours before departure: Non-refundable

5.2 Weather Cancellations

Should our captain deem weather conditions as perilous, we'll propose to:

  • Rebook your charter for a subsequent available date at no extra charge
  • Return the full amount if rescheduling is unachievable

5.3 Mechanical Issues

If the vessel allocated to you encounters mechanical issues, we shall attempt to provide a fitting substitute. Should no substitute be available, a full reimbursement will be issued.

6. Safety and Conduct

6.1 Safety Requirements

Every passenger must:

  • Heed all directions provided by the crew
  • Don safety gear as instructed
  • Inform us of any health conditions that could impact their safety
  • Stay within designated parts of the vessel

6.2 Prohibited Items

The items listed below are forbidden aboard:

  • Containers made of glass
  • Illicit substances
  • Weapons or firearms
  • Large quantities of drinks (beyond what's reasonable for consumption)
  • Animals (except when pre-authorized)

6.3 Conduct

Guests are expected to behave in a manner that is considerate and respectful. Should a passenger's conduct pose a threat to safety or detract from other guests' experiences, we retain the right to terminate the charter immediately without offering a refund.

7. Liability and Insurance

7.1 Our Liability

Our accountability is constrained to the sum paid for the charter. We hold no responsibility for:

  • Injuries sustained due to passenger's own carelessness
  • The loss or destruction of personal belongings
  • Indirect, incidental, or punitive losses
  • Delays resulting from weather or situations outside our command

7.2 Insurance Coverage

Our vessels and operations are protected by comprehensive marine insurance policies. It is the passenger's duty to secure their travel and personal insurance.

7.3 Assumption of Risk

Engaging in our charter services implies that you recognize the intrinsic hazards involved in nautical activities and accept responsibility for your own security and safety.

8. Modifications and Itinerary Changes

We maintain the right to alter itineraries, courses, or timetables as required by weather, safety reasons, or operational demands. All efforts will be made to offer similar substitute experiences.

9. Force Majeure

We shall not be held accountable for deferrals, abrogations, or amendments brought about by forces outside of our control, which include, but are not restricted to:

  • Extreme weather situations
  • Catastrophic natural events
  • Decrees by government bodies
  • Port discontinuations
  • Machine failures
